Terms and Conditions
Last updated: October 9, 2025
1. Agreement to Terms
By purchasing or downloading any digital product (including trailer plan PDFs and 3D printable files) from Escuber – Trailer Experts (“Escuber”, “we”, “us”, “our”) at escuber.com.au, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you have any questions, please contact us before completing a purchase. If you experience any issue with a product you’ve purchased, notify us promptly via our contact page.
2. Nature of Our Products (Digital Goods Only)
Escuber provides non-tangible digital goods (e.g., downloadable PDF plans, technical guides, STL/3MF files for 3D printing, and related documentation). We do not sell physical products or hardware.
3. Intellectual Property & License
All content and materials available through our digital goods and website—including drawings, models, text, images, logos, trademarks, and other media—are the intellectual property of Escuber or our licensors and are protected by applicable copyright, trademark, and other laws.
When you purchase a digital product, Escuber grants you a personal, non-exclusive, non-transferable, revocable license to download and use the files for your own personal or in-house workshop use to fabricate the corresponding trailer or accessory once per purchase, unless the product page expressly permits otherwise.
You must not:
- Resell, share, distribute, sublicense, publish, upload, or otherwise make the files available to third parties (including public repositories, marketplaces, or social media).
- Remove watermarks, copyright notices, or proprietary legends.
- Claim the work (in whole or in part) as your own.
- Use any automated method to extract, scrape, or replicate content from our website or downloads.
Linking to our website is permitted provided it is fair and lawful and does not damage our reputation or suggest any form of association, approval, or endorsement where none exists. You must not frame, mirror, or otherwise alter the presentation of our pages, files, or brand.
4. Account, Access & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We may implement download limits, unique link protections, or other technical controls to mitigate fraud and unauthorized sharing.
5. Pricing, Taxes & Changes
Prices are shown on the product pages and may be displayed in various currencies. Taxes (if applicable) will be calculated at checkout according to the billing location and payment method. We may update product content, pricing, or availability at any time without notice.
6. Refund Policy (Digital Downloads)
Because our products are non-tangible, irrevocable digital goods, all sales are final and non-refundable once access to the download has been provided, except where a refund is required by applicable consumer law. If you encounter a technical problem preventing you from accessing or opening a purchased file, contact us promptly so we can assist (e.g., re-issuing links, providing alternative formats).
7. Technical Information, Standards & Disclaimer
Our digital goods are prepared with professional care and intended for competent builders and fabricators. However, all information is provided as general information only and not as professional engineering, legal, or compliance advice.
Where relevant, our plans may reference common industry concepts or summarize public standards (e.g., Australian Design Rules and Vehicle Standards Bulletin 1 (VSB1) for light trailers, or other jurisdictional guidelines). These references are provided for information only. Regulations vary by country, state, and locality, and may change over time.
You are solely responsible for:
- Verifying all dimensions, materials, weld symbols, fasteners, and fabrication methods prior to manufacturing;
- Ensuring the final build quality is safe and fit for purpose;
- Confirming compliance with all applicable road, safety, and registration rules in your jurisdiction;
- Obtaining inspections, approvals, and registrations required by local authorities;
- Maintaining the trailer in a serviceable condition for continued safe use.
To the fullest extent permitted by law, Escuber does not warrant that the information in any digital product is complete, current, or suitable for your specific application, and provides no guarantee that any resulting build will pass inspection or achieve legal registration.
8. Third-Party Links & References
Our website and products may include links to third-party websites or references to third-party services. Such links and references are provided for convenience only and do not constitute endorsement. We do not control and are not responsible for the content, accuracy, or policies of third parties.
If you believe any content or link on our site infringes a third party’s rights (including copyright), please contact us immediately with details so we can review.
9. Limitation of Liability
To the maximum extent permitted by law, Escuber and its officers, employees, agents, and contractors will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, losses, costs, or expenses of any kind (including legal fees) arising from or in connection with:
- Your access to, use of, or inability to use our website or digital goods;
- Any errors, omissions, interruptions, delays, viruses, or harmful code;
- Any decisions or actions you take based on our content;
- Any non-compliance of your fabricated trailer with applicable laws or standards.
Your sole and exclusive remedy for dissatisfaction with the website, products, or these Terms is to stop using the website and not purchase further products.
10. Availability, Maintenance & Changes
We do not guarantee uninterrupted or error-free access to our website or downloads. We may change the content, format, delivery method, or availability of any digital product or page at any time without notice. We may also suspend or terminate access (in whole or in part) for maintenance, security, legal, or operational reasons.
11. Support
For support, please use our contact page or email. We typically assist with:
- Download/link issues, file extraction/opening, and format compatibility;
- Clarifications regarding plan reading and interpretation;
- General technical pointers about the files themselves.
Support does not include custom engineering services, legal compliance checks, or jurisdiction-specific certification. Custom design work, when offered, may be scoped and quoted separately.
12. Privacy
Your use of the website is also subject to our Privacy Policy, which explains how we collect, use, and safeguard personal information. Please review it alongside these Terms.
13. Updates to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the current version. Changes are effective when posted on this page. We encourage you to review the Terms periodically.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of laws principles. You submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or relating to these Terms or your use of our website/products.
